			<content:encoded><![CDATA[<p>Washington has enacted its Ignition Interlock License (IIL) program as of January 1, 2009. This program allows for restricted driving privileges for drivers with a suspended or revoked license due to an alcohol related DUI or Physical Control violation. The Ignition Interlock License requires <img class="alignleft size-medium wp-image-41" title="washington-state-flag" src="http://breathalyzerinterlocks.com/wp-content/uploads/2009/12/washington-state-flag1-300x180.gif" alt="washington-state-flag" width="300" height="180" />that any car driven by the individual have an ignition interlock device (IID). However, every car that the license holder owns does not have to have an IID, only every car the licensee drives. This does include work vehicles, though this requirement may be waived if the employer signs an Employer Declaration for Ignition Interlock Waiver. A commercial vehicle may not be driven.</p>
<p>There are specific procedures and requirements that must be followed in order to obtain an Ignition Interlock License.  The requirements include:</p>
<ul>
<li>A valid driver license prior to the offense or revocation for alcohol related DUI or Physical Control</li>
<li>Arrest for, or conviction of, an alcohol related DUI or Physical Control</li>
<li>The driver&#8217;s license suspension is not for Minor in Possession, Vehicular Assault, Vehicular Homicide, Habitual Traffic Offender, or Reckless Driving reduced from an alcohol related DUI</li>
<li>No conviction for vehicular assault or vehicular homicide within seven years of the incident for which the IIL is being requested</li>
<li>A residential address in Washington State</li>
</ul>
<p>The procedure for obtaining an Ignition Interlock License requires that a court order the individual to apply for the IIL if convicted of an alcohol related DUI. A person may apply at any time, whether after being arrested or after the revocation hearing, if their license is suspended or revoked by the DOL. It is important to note that after receiving an IIL the licensee waives the right to a hearing on the license suspension or revocation.</p>
<p>Of course, an ignition interlock system must be installed on every car the individual will drive. The Washington State Department of Licensing must receive proof of installation from the ignition interlock installer. You can find contact information for the manufacturers of <a href="http://breathalyzerinterlocks.com/washington-interlock-models/" target="_blank">Washington DOT approved ignition interlock breathalyzers</a> here. The approved in car breathalyzer manufacturers should be able to guide you to a local interlock installation service center.</p>
<p>The licensee must provide proof of insurance, which usually requires SR-22 insurance. The licensee must also submit an Ignition Interlock License Application to Driver Records, Department of Licensing, PO Box 9048, Olympia, WA 98507-9048, or deliver the application in person to any Washington State Driver License Office. The Washington State Department of Licensing must approve all applications before an IIL is granted. The DOL will relate approval or denial in writing.</p>
<p>The time period that the breathalyzer interlock device is required varies depending on the offense or reason for revocation or suspension. The length of time is two years for an IIL for a deferred judgment for an alcohol related offense. For a conviction for DUI or Physical Control the period is one year for the first offense, five years for the second, subsequent offenses require 10 years.</p>
<p>There are several fees and costs that are in addition to the initial application fee and are ongoing. These include the cost of purchasing or leasing the ignition interlock device and having it installed, the cost of having it removed at the end of the IIL period, maintenance on the device, and a monthly Interlock Device Revolving Fund. Assistance with these costs may be obtained by submitting an Ignition Interlock Device Financial Worksheet.</p>
<p>The license may have further restrictions on it if the suspension or revocation is for offenses that also require the Occupational/Restricted Driver License (ORL). These are restrictions as the hours, days, and locations that a person may drive.</p>
