<p>DUI offenders in Georgia may have to have an ignition interlock device (IID), also known as an in car breathalyzer, installed in their vehicle before regaining driving privileges. If requried to have the IID breathalyzer installed the offender must follow specific procedures and use an approved ignition interlock service provider.</p>
<p>The device must be installed on every vehicle the offender owns or operates, and the IID will have to be used by anyone operating the vehicle before the vehicle will start. Employees may be able to operate an employer&#8217;s car within the scope of their business if the employer is notified of the IID requirement and proof of notification is kept in the vehicle.</p>
<p>In addition to the costs of breathalyzer IID installation the offender will have to pay for maintenance or calibration fees. If facing financial hardship the person may petition the court to allow an extended payment plan.<br />

<p>Is a new DUI Breathalyzer Ignition Interlock law going to be enacted by the federal government? In 1998 the US Congress passed the Transportation Equity Act of the 21st Century. This act in essence mandates states to require repeat DUI offenders have breathalyzer interlocks installed in their vehicles in order to receive increased highway funding.</p>
<p>In December of 2009 Senator Tom Udall, a Democrat from New Mexico, introduced new legislation that would mandate states enact laws requiring all DUI offenders have ignition interlock devices (IID) placed in their cars. <a href="http://breathalyzerinterlocks.com/how-to-obtain-a-new-mexico-ignition-interlock-license/" target="_self">New Mexico</a> was the first state to adopt such measures, though Alaska, Arizon, Arkansas, Hawaii, Louisianna, Nebraska, <a href="http://breathalyzerinterlocks.com/new-york-ignition-interlock-installers/" target="_self">New York</a>, Utah, and <a href="http://breathalyzerinterlocks.com/washington-ignition-interlock-license/" target="_self">Washinton</a> have the same requirement.</p>
<p>If the bill passes, states will have to require the vehicle breathalzyer for all DUI offenders for a period of six months. The bill&#8217;s co-sponsor is Frank R. Lautenberg of New Jersey. The bill is also supported by Mothers Against Drunk Driving (MADD).</p>
<p>Proponents point to statistics showing a drop in repeat DUI offenders for states requiring IIDs. Meanwhile critics say that the devices are not reliable and may indicate false readings. While ignition interlock devices are not foolproof the statistics do show a drop in DUI recidivism when used.</p>

			<content:encoded><![CDATA[<p>Breathalyzers, also known as alcohol breath testers, are becoming a more popular device for personal use. These devices are designed to measure the amount of alcohol in a person&#8217;s bloodstream, or their blood alcohol content (BAC), thus indicating whether a person is over the legal limit to drive. However, these devices are not without controversy and a DUI may result if the breathalyzer is inaccurate or used irresponsibly.</p>
<p>The most obvious question regarding whether personal breathalyzers actually work is: are the devices accurate? Does the breathalyser indicator actually reflect the BAC of the user. In large part this depends on the model of breathalyzer, the type of sensor the breathalyzer uses, and the calibration and maintenance that the breathalyzer has received.</p>

<p>Many of the professional grade hand held <a href="http://breathalyzerinterlocks.com/bactrack-select-s80/" target="_self">breathalyzers that use fuel cell technology sensors</a> measure the electrical charge produced by electrochemical interactions with alcohol.  Fuel cell sensors are less likely to give false readings from ketones in diabetics or from cigarette smoke or mouthwash. However, they do require calibration or replacement of the fuel cell sensor.</p>
<p>Other breathalyzers use semi-conductor sensors to measure the amount of alcohol released as breath from the lungs. These breathalizers come in a variety of accuracy levels, depending on the materials used. Some of the semi-conductor models are as accurate as fuel cell breathalyzers while others are much less accurate. For an accurate breathalyzer you should expect to spend over $90, and you should be very leery of the <a href="http://breathalyzerinterlocks.com/mini-breathalyzers/" target="_self">cheap mini-breathalyzers</a> with an accuracy of +-.02 or greater.</p>
<p>Besides the accuracy of the device police officials have expressed concern over drivers using a breathalyzer and gaining false confidence in their ability to drive. This means that even if a breathalyzer accurately reflects your BAC and indicates you are under the legal limit, you may still be arrested for a DUI, or DWI, if the police officer believes you are impaired. Thus, a breath alcohol test may not work to prevent a DUI arrest. In nearly all states the legal limit is .08, but studies have shown that drivers may become impaired at levels as low as .05. Thus, a person should use caution in deciding to drive based on a BAC level close to the legal limit.</p>
<p>There are also concerns of breathalyzer devices being misused as a device for party or drinking games. There are reports of drinking games consisting of using an alcohol breath test to see who can achieve the highest BAC. Such as games may cause blood alcohol poisoning resulting in severe vomiting, coma inducement, or even death. Such games are particularly prevalent and dangerous for inexperienced drinkers such as teenagers and college students.</p>
<p>In short, if you wish to use a personal breathalyzer ensure you purchase a professional grade device with the greatest accuracy possible. This means one around +-.005. There are a variety of models that can achieve this level of accuracy, but they must be properly maintained and calibrated, which does have additional costs. In addition, the user should realize the limitations of the device and that regardless of the breathalyser results, they may still be charged with a DUI if impaired. Finally, do not abuse any type of breath alcohol test by using it in a drinking game to compete for the highest BAC. <p>The Breathkey is an easy to use personal breathalyzer. You should always wait 10 to 20 minutes after your last alcoholic beverage to ensure that the alcohol is removed from your mouth. When operating, you merely press the start button, wait for the device to read BLOW, then blow into the mouthpiece for four seconds until the tester beeps, and then wait for your BAC reading.</p>
<p>The Breathkey has been approved by the FDA, but not the Department of Transportation (DOT). This means that it is safe to use but the level of accuracy does not meet DOT standards. The Breathkey has an accuracy of plus or minus .01 BAC at .08 BAC. DOT standards, and the breathalyzers used by police officers, have an accuracy range of plus or minus .005 BAC at .08 BAC. So, while the Breathkey is a safe device that does measure blood alcohol content keep this accuracy range in mind when making decisions regarding drinking and driving. Further, remember that you may be charged regardless of BAC indicators.</p>
<p>This device does not have the novel features of many other keychain mini-breathalyzers, such as a flashlight, stopwatch, or alarm, but is marketed closer to a professional grade breathalyzer.</p>

This is more expensive than other mini breathalyzers but it does have the fuel cell technology and provides a digital readout that other cheaper mini breath testers do not have. <p>New York State will allow some people convicted of an alcohol related offense to regain limited driving privileges with the installation of a certified ignition interlock device (IID). The IID will prevent the driver of a vehicle from starting the car if a preset level of alcohol is detected on the driver&#8217;s breath.</p>
<p>In order to take advantage of this program the person must use a New York approved IID and have it installed by an approved ignition interlock installer. <p>The companies listed below are approved by the Maryland Department of Transportation&#8217;s Motor Vehicle Division to provide ignition interlock devices (IID), or in car breathalyzers. These providers may be contacted to find IID installation services in your area.</p>
<p>An ignition interlock device requires the driver of the vehicle to blow into the device and will measure the driver&#8217;s blood alcohol content (BAC). If the person&#8217;s BAC exceeds the a preset limit the car will not start.</p>
<p>The costs of installation, leasing of the device, as well as maintenance and calibration costs must be paid by the person in the program.</p>
<p>The procedures for participating in the Maryland Ignition Interlock Program are provided to eligible drivers by a Maryland District Court, the Office of Administrative Hearings, and the Medical Advisory Board.</p>

In addition, those violating the Implied Consent may also use an Ignition Interlock License. This license requires the installation of an ignition interlock device (IID), also called an in-car breathalyzer, on every vehicle the license holder drives. This option is only available for Class D, E, or M licenses.</p>

<p>The device requires the driver to blow for several seconds into the breathalyzer, which determines the blood alcohol content (BAC) of the driver. If a preset BAC level is exceeded the vehicle will not start. The IID may also have the driver submit to rolling tests, or retests while the car is being driven. These retests help ensure the driver is the individual who gave the original breath sample.</p>
<p>The system must be purchased or leased and installed by an approved Provider. A list of <a href="http://breathalyzerinterlocks.com/new-mexico-ignition-interlock-providers-and-installers/" target="_self">approved New Mexico ignition interlock installers</a> is also available.</p>
<p>The state has set out a list of procedures that must be followed in order to obtain the Interlock License.</p>
<p>You should first make sure that you qualify for the ignition interlock license. To do this contact the Motor Vehicle Division (MVD) at 888-683-4636.</p>
<p>Next, you will have to show positive proof of identification.</p>
<p>You will also have to provide proof of financial responsibility. This means an insurance policy, insurance certification, insurance binder, or a State Treasurer&#8217;s Certificate of Deposit or a Surety Bond Certificate issued by the Mandatory Insurance Division of the MVD.</p>
<p>You must show the lease agreement or contract with the installer as proof that an ignition interlock device has been attached to all cars you will drive.</p>
<p>Complete an Affidavit of Acknowledgment, have it notarized, and submit it to the MVD with $53.00 for the ignition interlock license fee. The affidavit can be faxed to you by calling 888-683-4636 or can be downloaded from http://ipl.unm.edu/traf/certification/InterlockLic.htm#Insurance1. Remember, the affidavit must be notarized before you take it to the Motor Vehicle Division (MVD).</p>
<p>Typical costs will include the installation fee, a monthly rental rate, and the license fee, which is currently $53.00. The ignition interlock device will have to be periodically calibrated at the approved installation service center.</p>
<p>Remember, a New Mexico ignition interlock license is different from a limited license. For more information contact the MVD or visit their website. 			<content:encoded><![CDATA[<p>Connecticut has instituted an Ignition Interlock Device Program that requires certain drivers to have an ignition interlock device (IID) placed on their vehicle for 24 months. The 24 month period with the ignition interlock device can only start after a one year license suspension.</p>
<p>An ignition interlock device, also known as an in-car breathalyzer or breath alcohol test, is connected to the vehicles ignition system. The driver must blow into the device for several seconds in order for the device to ascertain the driver&#8217;s blood alcohol content (BAC). If the amount of alcohol in the driver&#8217;s blood exceeds a predetermined level the vehicle will not start.</p>

<p>The ignition interlocks approved by the Connecticut Department of Motor Vehicles (DMV) also require additional retests, or rolling tests, as the vehicle is being driven. Of course, for safety reasons the car will not shut off if the driver fails the retest. Rather, an alarm will sound, often consisting of flashing the lights and sounding the horn. This is to ensure that the driver is the same person who originally blew into the ignition interlock system. Some ignition interlock devices also take a picture when the breathalyzer is used.</p>
<p>In addition, attempting to tamper, remove, or cheat the interlock system may result in an addition conviction and a driver license suspension. A driver&#8217;s license suspension will also result from failure to comply with the Connecticut Ignition Interlock Program requirements.</p>
<p>The program is available for people convicted of a second Driving Under the Influence of Alcohol or Drugs (DUI), a conviction for Vehicular Assault, or a conviction for Vehicular Manslaughter. The person must first have served one year of a driver license suspension before they are allowed to use an ignition interlock to regain their driving privileges.</p>
<p>To be able to take part in the Connecticut ignition interlock program the person must also meet the eligibility requirements and follow the procedures for the program. The eligibility requirements include having a Connecticut driver license, being eligible for reinstatement, and not have further suspensions or pending suspensions.</p>
<p>After meeting all of the interlock program&#8217;s eligibility requirements the personmust then fill out and submit an Ignition Interlock Device Application (Form RS-1). This form can be found at the DMV&#8217;s website. Any eligible persons should also be contacted by the Connecticut DMV sometime before their one year suspension is over regarding their eligibility and an application for the program.</p>
<p>Finally, after meeting all of the eligibility requirements, submitting the application, and gaining acceptance into the interlock program the person should have an ignition interlock device installed on all of the vehicles they own or operate. In order to be accepted into Connecticut&#8217;s ignition interlock program all vehicles owned or operated by the person must have a breathalyzer interlock device installed. <a href="http://breathalyzerinterlocks.com/connecticut-interlock-vendors/" target="_blank">Connecticut has approved four vendors to supply the interlock systems</a>. The installation must then be verified with the Connecticut Department of Motor Vehicles (DMV).</p>
